Shoalhaven Local Environmental Plan (SLEP)

What is an LEP

A Local Environmental Plan, often called LEP, is the principle statutory planning document prepared by Council under the requirement of the Environmental Planning and Assessment (EP&A) Act 1979, to guide planning decisions for the Local Government Area (LGA). The plan allows Council to manage the ways in which land may be used through zoning and development controls.

Concerns

1  In the process of coupling zones together to comply with the State Governments
"template" there is now a wider range of land uses within the new zones many of which will compromise the objectives of the particular Zone.

2 There have been changes to zones not simply a one for one classification, but actual changes in zones from rural to residential for example. Zone changes are a serious matter and usually involve widespread community input. There has been none in relation to these changes.

3 There was been little community consultation prior to this document being lodged with the State government for approval for local exhibition.

4 There has been limited access to the LEP draft via Council Website. The downloading of this document has been blocked. What is so secret?

5 When the Draft document is returned by the State Government for exhibition most Councils are offering 13 weeks for community input. Shoalhaven council to date has offered 8 weeks. The document is large and complex and we should insist on on a exhibition period of at least 13 weeks.

                                          LEP REVIEW GROUP

The LEP review group consists of representatives from five Community Consultative Bodies (CCB's) and other organisations covering the whole of the Shoalhaven. The group has commenced the task of reviewing the detail contained in the Draft SLEP2009 submitted to the State Department of Planning (DOP) for review prior to Exhibition for community comment.

We urge you to become involved as a matter of URGENCY.

SAC Calls for Shoalhaven Council to Reject One Tree Bay Rezoning

The clearing of high conservation native forest and the threat to water quality in St Georges Basin will result if the proposed Miltonbrook development goes ahead. Acceptance of the Development Application (DA) will see a new town emerge housing 5000 people and a 16,000 m˛ commercial precinct established. 

Council will have to rezone land in order for the development to go ahead, in return Miltonbrook will hand over adjoining land to council for use as a National Park. Similar deals done at Gwandalan and Catherine Hill Bay have been described as "land bribes" by the Land and Environment Court. Doubts remain about the viability of the One Tree Bay project with a similar Miltonbrook "eco-development" at Tullimbar in financial difficulties.

Milton Meadows

The current zoning of Rural 1(b) on Part Portions 98 & 99 owned by Meadows of Milton should be retained in the Draft Local Environment Plan No. LP317 for the following reasons:
 

 Milton is a historic town with significant heritage value which has been classified as an Urban Conservation 

 Area by the  National Trust in 1986.

• The rural land surrounding Milton (known as its curtilage) is a vital part of its rural village character and an 
  integral to its heritage value.
• An urban zoning on this land would be a bad example of ribbon development as it is adjacent to the Princes
  Hwy and 1.5   km south of the town centre. 
• The buffer between Milton and Ulladulla would be reduced to only a few hundred metres. The danger would 
  be that the towns would join up in the future.
• the land is on a prominent ridge visible from all of the southern side of Milton township
• the land is high grade agricultural and could easily be used for intensive small farm activities
  These arguments are for no development at all on the land. 
 
If you want support the idea of a retirement village on the land then you can request that the Scenic Hatching be removed which will then allow a retirement complex only.

Burrill Lake
Burrill Lake remains closed while Council twiddles its thumbs. We expect our council to take action. The short term solution to the lake closure is obvious, remove the sand blocking the entrance. The long term solution, erect a rock training wall. Eurobodalla Council can manage to fix the problems at Narooma and Moruya so why can't Shoalhaven Council do the same. Passing the buck to the State Government is not the answer, we need a council that can talk to the relevant bodies and get the job done.

                     Climate Change:  Fact or Fiction? 

Whether fact or fiction Shoalhaven Council will introduce a new Development Control Plan that will prevent or hinder development on large stretches of foreshore within the Shoalhaven.

Existing landowners will be subject to strict development controls that will in some areas reduce the value of their land to almost zero. These controls are a State Government edict according to Council. Lines have been drawn defining precincts of future beach erosion and/or sea inundations and of cliff/slope instability on our foreshores. Further areas have been labeled potentially hazardous.  

The future management of climate change throughout the world and possible effects on our oceans are still a matter for considerable debate. Until a clear and definitive picture emerges, knee-jerk reactions by Governments and Councils will only cause financial hardship and mental anguish to many of those residents who have chosen to live on our coastline.
